If you're bringing your wife over on a k-3, the stepdaughter can be included automatically, if under 21. however, if she was 18 or over at the time you married, you wouldn't be able to file an immigrant petition for her. If she was under 18, you could either bring her over on the K-3 or file a separate IR-2 petition for her as her stepfather. As for how long it takes, that would depend on whether you're in the Philippines and can file directly at the embassy, or have to file in the US. figure a year if you file in the US. however, if your wife is being processed on the K-3, she could come directly with your wife as she would be included on that petition.Got married 5/23/09 to a philippiines national and want to bring my family to the US, any advice on the steps?
In my case, I was here on K3 visa. My kids weren't traveling with me. I was told that my kids has derivative status (as K4) until I adjust status here in states. When I got my I-485 approved, and have my green card, the kids no longer can come as K4. So my husband file another I-130 for my kids. In your case, I assume you're still in the process of submitting your petition. So when you process the visa of your wife, just name the person who will travel with her including your stepdaughter (if your stepdaughter is below 18 years). as George L said. But you might need a written consent if the father of your stepdaughter is still alive, just check for it. I think it's required by the Commission of Filipino Overseas CFO), where your wife needs to attend a counseling sessions with the kids before she's allowed to travel or even get a passport in your name. Me and my husband were in Philippines when he file the petition until I was ready for interview. But we mailed the petition here in states.
